1. Acceptance of Terms

By accessing or using the Xcape Networth platform ("Service"), operated by XcapeSuite ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. Material changes will be communicated through the platform. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.

2. Description of Service

Xcape Networth is a web-based platform that helps individuals calculate and track their net worth for purposes of U.S. expatriation compliance, specifically in connection with IRS Form 8854. The Service provides tools for asset and liability tracking, multi-currency conversion, covered expatriate test calculations, report generation, and secure advisor collaboration.

The Service is designed to assist with expatriation planning and compliance. It does not replace professional tax, legal, or financial advice.

3. Account Registration

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

4. Subscription and Payments

Access to Xcape Networth requires a paid subscription at a rate of $229 per month ("Subscription Fee"). The Subscription Fee is billed monthly on the anniversary of your subscription start date.

Payment is processed through our third-party payment provider. By subscribing, you authorize us to charge your designated payment method on a recurring basis. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are provided.

We reserve the right to change the Subscription Fee with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new fee.

5. Permitted Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the Service for any fraudulent, misleading, or illegal activity
  • Attempt to gain unauthorized access to any part of the Service, other user accounts, or related systems
  • Reverse engineer, decompile, or disassemble any aspect of the Service
  • Use automated scripts, bots, or crawlers to access the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Share your account credentials with third parties or allow others to access your account

6. Intellectual Property

The Service, including all software, design, text, graphics, interfaces, and underlying technology, is the property of XcapeSuite and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal expatriation compliance purposes during the term of your subscription.

You retain ownership of all data you enter into the platform. By using the Service, you grant us a limited license to process and store your data solely for the purpose of providing the Service.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Xcape Networth is a compliance planning tool and does not constitute tax advice, legal advice, or financial advice. The calculations, reports, and information generated by the Service are for informational and planning purposes only. You should always consult with a qualified tax professional, attorney, or financial advisor before making decisions related to U.S. expatriation.

We do not guarantee the accuracy of foreign exchange rates, tax thresholds, or regulatory information provided through the Service. While we make reasonable efforts to keep such information current, regulations and rates change frequently.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XCAPESUITE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total cumulative liability to you for all claims arising out of or related to the Service shall not exceed the total amount you have paid to us in Subscription Fees during the twelve (12) months immediately preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless XcapeSuite, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, upon notice. Upon termination, your right to use the Service ceases immediately. You may request an export of your data within 30 days of termination, after which your data may be permanently deleted.

Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the English language.

You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.
